The Apple vs. Epic lawsuit is into its second week, and it already seems as if the two sides are running out of things to argue about.
Apple and Epic’s lawsuit is well into its second week and the number of stories and reveals to have been spun from it is already well into double figures. However, the most bizarre argument to date only just happened. Apple threw up a shot of Peely, Fortnite’s banana character. Well, it actually showcased Agent Peely, the persona the banana assumes when it is wearing a tuxedo.
Apple’s attorney actually stated in court that it opted to use Agent Peely as it didn’t think the banana in its unclothed form was appropriate to show considering the circumstances. Apple’s implication that the inclusion of a naked banana in a game isn’t okay reared its head again a few hours later. Epic showed the court regular Peely, highlighting how ridiculous it is that Apple would suggest the character’s inclusion isn’t okay.
A number of elements to emerge from this case have sent the internet into a frenzy, but not in the way this bizarre Peely disagreement managed to do. While most Fortnite fans think the mere mention of Peely in a court of law is equal parts hilarious and ridiculous, others have thanked Apple. There has been a running joke since Peely’s introduction that the banana is cursed, and clearly, Apple agrees with that.
The biggest takeaway of all from the exchange, and a line that will go down in Fortnite history, has already been repeated thousands of times on Twitter. “It’s just a banana, ma’am,” Epic’s VP of marketing said when asked if naked Peely is inappropriate. Prepare for that to be a meme for years to come, and maybe even included in a Fortnite skin or emote of some sort once this issue is all said and done.
How the case digressed into discussing Peely’s attire is another matter entirely. It certainly doesn’t relate to the core of the case, nor does it help either side resolve the issue regarding Fortnite’s presence on mobile, or lack of it. The case could well change the way mobile gaming works across the board, but probably won’t have a lasting effect on what Peely can and can’t wear in-game.
